1. Introduction & Acceptance of Terms

Welcome to Stylely ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Stylely website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Services

Stylely provides an AI-powered virtual try-on service that allows users to visualize how clothing items would look on them. Our Service includes:

Virtual try-on technology using artificial intelligence
Personal wardrobe management and organization
Outfit saving and sharing capabilities
Style feed and community features

3. User Accounts & Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. AI-Generated Content Disclaimer

Stylely uses artificial intelligence to generate virtual try-on images. You acknowledge and agree that:

AI-generated images are approximations and may not accurately represent how clothing will look in real life. Factors such as lighting, fabric texture, fit, and body proportions may differ from the generated results. We do not guarantee the accuracy, quality, or suitability of any AI-generated content.

The AI technology is provided "as is" and we make no warranties regarding its performance, accuracy, or reliability. Results may vary and should be used for entertainment and reference purposes only.

5. Image Usage & User Rights

By uploading images to our Service, you grant Stylely a non-exclusive, worldwide, royalty-free license to use, process, and store such images solely for the purpose of providing the Service to you.

You represent and warrant that you own all rights to the images you upload, or have obtained all necessary permissions to upload and use such images. You must not upload images of other individuals without their explicit consent.

We may retain AI-generated images to improve our services, but we will not sell or share your personal images with third parties for marketing purposes without your consent.

6. Credits, Payments & Billing

Stylely operates on a credit-based system. Credits are required to generate virtual try-on images. Credits can be obtained through free daily claims, signup bonuses, streak rewards, or purchased credit packs.

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are displayed in USD unless otherwise specified and may be subject to applicable taxes.

Purchased credits do not expire and remain in your account until used. Credits are non-transferable between accounts.

7. Refund Policy

Due to the digital nature of our Service, all credit purchases are final and non-refundable once credits have been used. However, we may consider refund requests on a case-by-case basis for unused credits within 14 days of purchase.

If you experience technical issues that result in loss of credits, please contact our support team, and we will investigate and provide appropriate remediation.

8. Prohibited User Conduct

You agree not to engage in any of the following prohibited activities:

Uploading images containing nudity, explicit content, or inappropriate material
Uploading images of minors without parental consent
Using the Service to harass, abuse, or harm others
Attempting to reverse engineer, decompile, or hack the Service
Using automated systems, bots, or scripts to access the Service
Violating any applicable laws, regulations, or third-party rights

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Stylely and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any images you upload to the Service. However, the AI-generated try-on images created using our technology are provided for your personal use only and may not be used for commercial purposes without our written consent.

10. Third-Party Services

Our Service integrates with third-party services that are subject to their own terms and privacy policies:

Google AI - For image processing and AI generation
Stripe - For payment processing

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STYLELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Stylely and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of any third party.

14. Termination of Service

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Any unused credits in your account may be forfeited upon termination for cause.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Stylely operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

16. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We will try to resolve the dispute informally within 30 days.

If the dispute is not resolved within 30 days, either party may pursue formal dispute resolution. Any legal proceedings shall be conducted in English.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
